Technical Regulations of the Customs Union

"On the safety of light industry products "

General Provisions

1. The Technical Regulations of the Customs Union under the title "On the safety of the light industry products" are complied in accordance with the Agreement on the common principles and standards of essential technical regulations in the Republic of Belarus, the Republic of Kazakhstan, and the Russian Federation dated on November 18, 2010.

2. The Technical Regulations are complied to state unified and obligatory requirements on the whole territory of the Customs Union, which are mandatory for the application and enforcement for all light industry products, providing free movement of the light industry products on the common Customs territory of the Customs Union.

3. If some other Technical Regulations of the Customs Union for the light industry products of the Customs Union and (or) some other Technical Regulations of the Eurasian Economic Community (hereinafter - EurAsEC) are approved and there regulations state the requirements for the light industry products, the light industry products should meet the essential requirements of these Technical Regulations of the Customs Union and (or) EurAsEC Technical Regulations.

Article 1. Scope of application

1. The Technical Regulations cover all light industry products which are manufactured for their market circulation on the common customs territory of the Customs Union.

2. Light industry products (hereinafter - Products) listed in the Technical Regulations include:

- Textile materials;

- Apparel and knitted products;

- Machine-made coating and carpet products;

- Leather goods, textiles and haberdashery;

- Felt, unwoven felt and nonwovens;

- Footwear; 

- Furs and fur products;

- Leather and leather products;

- Artificial leather.

3. The list of the products under the present Technical Regulations is specified in Annex 1 of the present Technical Regulations.

4. The Technical Regulations shall not apply to the following products:

- used products;

- products manufactured by individual orders;

- products for medical purposes;

- special departmental in-house products used for individual protection and materials for their manufacture;

- products intended for children and adolescents;

- packaging made of textile materials, woven bags;

- materials and products for industrial use;

- souvenirs and crafts;

- sports products and products for the equipment of sports teams;

- wiggy products (wigs , false mustaches, beards, etc.).

5. The Technical Regulations establish the mandatory requirements for the light industry products on the territory Customs Union providing standards for human life and health protection as well as for prevention of any misleading actions for users (Consumers).

Article 2. Definitions

The Technical Regulations use the following terms and their definitions:

"Biological Security (Biosecurity)" is the state of the products which prevents any risk of health or life hazard for the Customer due to the hazardous and invalid microbiological, toxicological, physical, and physicochemical characteristics that do not meet the approved essential requirements;

"Pollutants or Hazardous Chemicals" are chemicals, the use of which may cause undesired or adverse effects for human health when their concentration in the products exceeds the permissible concentration level (threshold);

"Production and market circulation of products (marketability)" is concerned with market circulation of the products on the market of the Member States of the Customs Union, from the manufacturer’s or seller’s (distributor’s) warehouse or from a notified person serving the delegated functions of a foreign manufacturer or with the products shipped without storage or export to the Member States of the Customs Union;

“Applicant” is a natural person or a legal entity who applies for the affirmation of conformity (compliance) of the products with the Technical Regulations via certification or declaration of compliance (declaration of conformity);

"Identification of Products" is the procedure of identification for the light-industry products according to the present Technical Regulations of the Customs Union which includes standards for the current technical specifications;

"Manufacturer" is a legal entity or a natural person acting as an individual businessman under its own original brand name responsible for the production and sales (distribution) of the light industry products and their compliance (conformity) with the safety requirements of the present Technical Regulations;

"Importer" is a resident of the Member State of the Customs Union notified under the foreign trade agreement for the transfer of foreign light industry products, who is responsible for distribution and sales of these products and for their compliance with the safety requirements listed in the present Technical Regulations;

"Toxicity Index" is an integral parameter of acute toxicity as estimated from the in vitro germ culture tests;

"Mechanical Safety" is concerned with several quantitative parameters of the mechanical properties and structural characteristics of the products for the reduction and minimization of the risks related to health injury or life threat;

“Market Circulation of Light Industry Products " is the market circulation of the products from the manufacturer to the user, including and covering all operations and processes after their manufacture;

“Clothing” is a product (or a set of products) that is (are) worn by a person and bears utilitarian and aesthetic functions;

“User (or Consumer) of the Products” defines a legal body or an individual businessman who buys and consumes the products under of the present Technical Regulations;

“Sports goods" stands for the products which provide the necessary conditions for sports competitions and sports tournaments as well as for sports training and sessions in various sports;

“Parties” defines the governments of the Member States of the Customs Union;

“Standard Sample” is a standard sample (reference sample) that represents the articles belonging to the same product group by their end purposes (intended purposes) produced by the same manufacturer from the similar materials according to the standard protocol and standard recipe in line with the approved technical regulatory documents;

 “Authorized representative of the manufacturer” is a legal person or a natural person with the issued legal state registration, who is appointed by the manufacturer under the contract for performing actions on its behalf for certification and market circulation on the customs territories of the involved states and who is responsible for the noncompliance of the products to the Technical Regulations of the Customs Union;

"Chemical Safety" means the state of the product, which prevents any undesired risk related to human health and life hazard for the customer when concentration of hazardous and toxic chemicals exceeds the permissible level (threshold);

When the threshold of chemical safety is specified as "not allowed", safe concentration intervals for the hazardous substances should be identified according to standard procedures and testing protocols used for the control of hygiene and chemical parameters.

Article 3. Market Regulations

1. The light industry products are allowed for market circulation on the common Сustoms territory of the Customs Union provided they satisfy the Technical Regulations as well as with other approved essential technical regulations of the Customs Union under the condition that they have the confirmation of compliance according to Article 11 of the present Technical Regulations and according to other related technical regulations of the Customs Union.

2.  The light industry products, which fall below the requirements of the present Technical Regulations, should not be labeled with a unified confirmation mark on the market of the Member States of the Customs Union and they are not allowed for their production and market circulation.

3. Market circulation of the products should be allowed when complete and adequate information on the products is provided using special labeling&marking to prevent any misleading actions for users (consumers) with respect to the safety of the products.

Article 4. General provisions on safety of light industry products

1. Safety of light industry products is estimated with respect to the following indicators:

mechanical parameters (breaking stress, strength, flexibility, impact strength);

chemical parameters (maximum permissible concentrations of hazardous chemical substances in air and (or) aquatic environments, the list of which is complied depending on the chemical composition of the material and (or) use of the products);

biological parameters (hygroscopic properties, air permeability or breathability, water impermeability, electrostatic field, index of toxicity or local irritant effect, color stability).

2. For the materials contacting with human skin, first-layer and second-layers clothings, home footwear, summer and beach foorwear as well as internal layers in some other kinds of footwear, the index of toxicity estimated in aquatic environments should range between 70 and 120 percent, including; in air, from 80 to 120 percent (including) or there should be no local skin-irritating effect.

3. The intensity of the odor of the light industry products and materials used for their production should not exceed 2 points under natural conditions.

Article 5. Safety requirements of textile materials, textile products, clothing, and haberdashery

1. Textile materials and textile products are characterized by the parameters of biological and chemical safety, and their parameters are specified according to their functionality (intended purposes) and raw materials.

2. Depending on use (intended purposes) and contact area with the human body, clothing and clothing products are divided into the first-layer, second-layer, and third-layer clothings and products.

First-layer clothing and products are the products which have a direct contact with human skin such as underwear and linens, corsetry and swimwear products, summer hats, hosiery, handkerchiefs, kerchief-scarf products as well as other similar products.

Second-layer clothing and products are the products which have a limited contact with the human skin; they include dresses, gowns, blouses, shirts, pants, skirts, unlined suits, sweatshirts, sweaters, pullovers, headwear (except summer), mittens, gloves, winter mittens, socks and hosiery and other similar products.

Third-layer clothing and products are the products intended for wearing over the second-layer clothing such as coats, jackets, pilot coats, suits with lining, and other similar products.

3. For textile materials and textile clothing, textile haberdashery, the parameters on biological and chemical safety must comply with the standards listed in Annex 2 of the present Technical Regulations.

Release (emission) of harmful and hazardous chemicals (migration rates) from textile materials, textile products, clothing, and haberdashery products should not exceed the limits specified in Annexes 2 and 3 of the present Technical Regulations.

The list of hazardous substances is complied according to the chemical composition of the materials and product types:

in textile materials, textile products, first-layer and second-layer clothing - in water (aquatic) environments;

in textile materials, textile products, third layer clothing and clothing accessories - in air or in water environments.

In the textile materials, textile products, first-layer and second-layer clothing, and haberdashery, the content of volatile hazardous chemicals due to the use of textile auxiliary substances in the manufacturing process is estimated. In this case, release (emission) of volatile chemicals should not exceed the limits specified in Annex 4 of these Technical Regulations.

Color stability of textile materials to washing and perspiration for the first-layer clothing and products should be not less than 4 points; in the case of dry friction, not less than 3 points.

Color stability of textile materials to washing, perspiration and sea water for swimwear and related articles should be not less than 4 points.

Color stability of textile linings to washing, perspiration, and dry friction should not be less than 4 points.

Color stability of textile materials to washing, perspiration, dry friction and distilled water for the second-layer and third-layer clothing and related products intended for some other purposes should be not less than 3 points, depending on the specified modes of treatments.

For dark denim materials dyed with dark natural dyes, the color may shade by 1 point.

Color stability parameters are estimated only by coloring of the white (contacting) material.

Article 6. Safety requirements for footwear, leather, artificial leather and leather goods

1. Footwear is characterized by the parameters of mechanical, biological and chemical safety.

2. Mechanical and biological safety of footwear is determined by the following characteristics and must conform to the standards specified in Annex 5 of these Technical Regulations.

Mechanical safety is defined by the following characteristics:

1) strength of attachment of soles and lower parts of shoes;

2) strength of the attached heel;

3) resistance of soles to multiple flexure;

4) impact strength of soles.

Biological safety of footwear is characterized by the following parameters: flexibility, water impermeability.

3. Chemical safety of footwear should meet the requirements specified in Annexes 3 and 8 of the present Technical Regulations.

Control over migration of hazardous substances from the materials of home, summer and beach footwear as well as from the materials in contact with human skin (inner layers of shoes) is carried out in an aqueous medium; for other types of footwear materials, in the air.

In winter footwear, polyurethane-based soles should have grooves on the running surface to prevent any slipping.

In the felt footwear, weight fraction of free sulfuric acid (from the water extract) should be not more than 0.7 percent.

4. Safety of leather goods is characterized by the following parameters:

1) mechanical properties - strength of handles, shoulder belts and bearing joints of the product bodies;

2) chemical parameters – maximum release of hazardous chemicals into the model air environment;

3) biological parameters - color stability of products to dry and wet friction.

Parameters of mechanical and biological safety for leather products should meet the requirements specified in Annex 6 of the present Technical Regulations.

Maximum permissible release of hazardous substances from the materials used in the manufacture of leather goods should meet the requirements specified in Annexes 7 and 8 of the present Technical Regulations.

Control over the release of hazardous substances from the leather materials and leather products is carried out in air.

5. Leather goods should meet the requirements on chemical and biological safety specified in Annex 8 of the present Technical Regulations.

Artificial leather must meet the requirements on chemical safety specified in Annex 3 and the requirements on biological safety specified in Annex 8 of the present Technical Regulations. 

Article 7. Safety requirements of clothing and leather goods, furs, and processed fur pelts

Safety of leather and fur clothing and goods as well as safety of processed fur pelts is characterized by the parameters of chemical and biological safety, which should satisfy the requirements specified in Annex 8 of the present Technical Regulations.

Textile materials in leather and fur clothing and goods must satisfy the safety requirements for textile materials.

Article 8. Safety requirements for machine-made coatings and carpet products, felt, unwoven felt and nonwovens, and related finished products

Safety of machine-made coatings and carpet products, felt and unwoven felt, nonwovens and other textile products must meet the following standards:

- The products after their treatment with antiseptics should have no mold odor;

- Electrostatic field on the surface of the products should meet the essential requirements specified in Annex 2 of the present Technical Regulations;

- Color stability should be not lower than 3 points;

- Weight fraction of free sulfuric acid in the aqueous extract of felt products should be lower than 0.7 percent;

- Requirements on chemical safety should meet the requirements specified in Annex 3 of the present Technical Regulations.

Article 9. Requirements for marking&labeling 

1. Marking&labeling of the products should be accurate, legible and available for inspection and identification. Marking is applied to the product, the label affixed to the product or the commercial label, the product packaging, the packaging of the products or onto the package insert for products.

Marking should include the following mandatory information:

- Name of the product;

- Name of the country of manufacture (origin);

- Name of a manufacturer or an authorized dealer (distributor) or an authorized representative of the manufacturer;

- Legal address of a manufacturer or a distributor or a person authorized by the manufacturer;

- Size (dimensions) of the product;

- Composition of raw materials;

- Trade mark (if any);

- Unified conformation marking of the products on the market of the Member States of the Customs Union; Customs Union Certificate-EAC

- Warranty of the manufacturer (if applicable);

- Date of manufacture;

- Batch number (if necessary).

2. Depending on the type and intended use of the light industry products, marking should include the following information:

For textile clothing and products, additional information should include:

- type and weight fraction (percentage) of natural and chemical raw materials in the upper and lining products. Deviations of the actual content of raw materials should not exceed + 5 per cent;

- model;

- care symbols of the products;

- instructions for safe use and product care (if necessary).

For knitted and textile fabrics, garment pieces, blankets, bedspreads, and curtains, additional information should include:

- type and weight fraction (percentage) of raw materials (pile surface for carpets and their products). Deviation of the actual content of raw materials should not exceed + 5 per cent;

- weight of a piece at the normalized relative humidity (for knitted fabrics);

- color stability and shape stability (for knitwear and textile fabrics);

- modes of processing and finishing (if any);

- care symbols of the products.

For footwear, additional information should include:

- model and (or) ID of the product;

- type of the material used for the manufacture of upper parts, lining and bottom parts of footwear;

- care instructions for footwear (if necessary). 

For clothing and fur products, additional information should include:

-type and processing modes of fur (colored or uncolored);

- care symbols of the products;

- care instructions for the products (when necessary).

For leather goods, additional information should include:

- name of the upper material;

- model;

- care instructions (if necessary).

For leather, additional information should include:

- area or weight of the leather;

- thickness (if required);

- grade. 

For fur pelts, additional information should include:

- type of fur;

- type of treatment;

- grade, mark;

- area or size.

3. Marking and information should be written in Russian or in the official language of the Member State of the Customs Union where the products are manufactured and distributed.

For the imported products, origin of the products (country), the manufacturer's name, and official business address can be written in the Latin alphabet. 

4. Specifications "environmentally friendly", "orthopedic" and other similar specific information are not allowed without appropriate acknowledgments.

Article 10. Compliance (Conformity) with Safety Requirements

1. Compliance of the light industry products with the present Technical Regulations is secured by the direct fulfillment of the safety requirements or by the fulfillment of the requirements listed in the documents on standardization and certification included in the Official List of Documents on Standardization; this fulfillment on a voluntary basis provides the fulfillment of the present Technical Regulations.

Fulfillment on a voluntary basis of the essential requirements of the above documents on standardization indicates the compliance with safety requirements of the present Technical Regulations.

2. Testing methods for the characterization of the light industry products are specified in the documents on standardization involved in the List of Standardization Documents, which includes testing protocols, methods, and measurements, including the rules of sampling, which are necessary to prove the compliance with the requirements of the Technical Regulations and assessment (confirmation) of product conformity.

Article 11. Evaluation of Compliance with the Requirements of the Technical Regulations

1. Before market circulation and distribution, the light industry products should be evaluated and verified for their compliance with the requirements of the present Technical Regulations, and this procedure includes declaration of conformity or certification.

For the evaluation of the compliance, an applicant is a duly registered legal entity or a natural person as an individual entrepreneur, which is a manufacturer (the person authorized by the manufacturer) or a vendor (supplier or distributor).

2. Evaluation of compliance includes identification of the products.

Identification of the light industry products is performed by:

- the manufacturer, the person authorized by the manufacturer, the seller (distributor) who declares the conformity of the light industry products with the requirements of the Technical Regulations and who is responsible for the market circulation of the products on the common Customs territory of the Customs Union;

- certification body (assessment (confirmation) of conformity) for the affirmation of the compliance of the light industry products with the certification requirements of the present Technical Regulations.

For the identification of the light industry products, organoleptic and (or) instrumental methods are used:

- In the organoleptic testing methods, the light industry products are identified by their name and type (intended use) of the products as well as by the compliance of their performance characteristics with the type of the related products and with the complied list of documents.

If the organoleptic method of identification does not provide accurate and reliable information on the products, the instrumental method is used. In the instrumental method for the identification of the light industry products, the tests are performed according to the approved list of documents on standardization, which include provisions and testing methods and measurements, including the rules for the sampling, which are necessary for the application and enforcement of the requirements listed on the present Technical Regulations and for the evaluation (affirmation) of the conformity of the products.

3. Declaration of the compliance (conformity) of the light industry products with the requirements of the Technical Regulations is performed using the schemes listed in Table 1 of the present Technical Regulations.

3.1. Declaration of conformity according to schemes 3d, 4d, 6d is performed for the following groups of products:

- second-layer and third-layer clothing and articles;

- knitted fabrics;

- linen fabrics and materials, clothings, towels;

- leather and fur clothing and articles;

- second-layer hosiery;

- hats;

- footwear, except milled footwear;

- machine-made carpets and coverings.

Declaration of conformity according to schemes 1d, 2d is complied for the products which are not involved in the group of products under the declaration of conformity according to schemes 3d, 4d, 6d, and in the group of products under certification.

Testing for the declaration of conformity is conducted:

- by the request of a manufacturer (or a person authorized by the manufacturer) or of a seller (distributor) in the testing laboratory or in the accredited testing laboratory (testing center) listed in the Unified Register of certification bodies and testing laboratories (testing centers) of the Customs Union (schemes 1d, 2d);

- in the accredited testing laboratory (testing center) listed in the Unified Register of certification bodies and testing laboratories (testing centers) of the Customs Union (schemes 3d, 4d, 6d).

3.2. Declaration of conformity (compliance) of the light industry products requires the following actions from the manufacturer (or the person authorized by the manufacturer) or the seller (distributor):

3.2.1. The manufacturer (or the person authorized by the manufacturer) and the seller (distributor) perform the following actions:

- Preparation of the file of documents confirming the compliance of the light industry products with the requirements of the present Technical Regulations, which includes:

copies of the documents affirming that the applicant is registered in a duly order by the Member State of the Customs Union as a legal entity or a natural person;

testing reports with the information on the tests of the light industry products (standard samples) (valid for no longer than 3 years);

copy of the certificate of conformity for the production quality management system (scheme 6d);

operational documents, technical and design documentation, information on raw materials and components (if available);

copies of the documents confirming the origin of light industry products; contract (supply contract) and shipping documentation (for the batch of products) (schemes 2d, 4d);

- identification of the light industry products according to item 2 of this Article.

Test report containing information on the tests of the product samples (standard samples) should include:

- issue date of the protocol and registration number according to the system adopted in the testing laboratory;

- name of the testing laboratory or name and registration number of the accredited test laboratory (depending on the declaration scheme);

- list of testing equipment;

- test conditions;

- name of the product;

- name and actual values of the tested parameters of the products;

- numbers and titles of regulatory documents on the applied testing methods.

3.2.2. Manufacturer:

- provides the control over production (manufacture) and takes all necessary measures to ensure that the manufacturing process ensures the compliance of the light industry products with the requirements of the present Technical Regulations (schemes 1d, 3d, 6d);

- takes all necessary measures to ensure that the process of production (manufacture) and stable work of the quality management system provides the compliance of the light industry products with the requirements of the present Technical Regulations (Scheme 6d).

3.2.3. A manufacturer (or the person authorized by the manufacturer) and a seller (distributor) receives a written declaration of conformity for the light industry products proving their compliance with the present Technical Regulations in the unified form approved by the Commission of the Customs Union and places a unified confirmation mark onto the products on the market of the Member States of the Customs Union.

3.3. The declaration of conformity shall be registered according to the procedure adopted by the Commission of the Customs Union.

3.4. Duration of the action of the declaration of conformity is specified when the declaration of conformity is issued:

- according schemes 1d, 2d, 4d - not longer than 3 years;

- according to schemes 3d, 6d – not longer than 5 years.

By the request of the applicant, the declaration of conformity according to schemes 1d and 2d may be replaced by the declaration of conformity according to schemes 3d, 4d, 6d or by certification. Declaration of conformity according to schemes 3d, 4d, 6d may be replaced by certification.

4. Affirmation of conformity of the light industry products with the requirements of the present Technical Regulations in the form of certification is carried out through the certification schemes listed in Table 2 of the present Technical Regulations for the following groups of products:

- underwear, corsets, swimwear and related articles;

- bed linen;

- first-layer hosiery.

4.1. Certification of the light industry products is performed by the accredited certification body [assessment (confirmation) of compliance] included in the Unified Register of certification bodies and testing laboratories (testing centers) of the Customs Union (hereinafter, the Certification Body).

4.2. Certification tests are performed by the accredited testing laboratory (testing center) included in the Unified Register of certification bodies and testing laboratories (testing centers) of the Customs Union (hereinafter, the accredited testing laboratory).

4.3. For certification of light industry products, the following list of the documents is provided by a manufacturer (a person authorized by the manufacturer), a seller (distributor or supplier) to the Certification Body:

- test reports with the results of the tests of the products (standard samples) confirming their compliance with the safety requirements of the present Technical Regulations (valid no longer than 3 years) (if any);

- operational documents, technical and design documentation, information on raw materials and components (if available);

- copy of the certificate of conformity for quality production management system for the light industry products (scheme 2c);

- copies of the documents confirming the origin of the light industry products; contract (supply agreement) and shipping documentation (for the batch of products) (scheme 3c);

- other documents confirming safety of the products (at the discretion of the applicant).

Test report on the test results for the products (standard samples) should include:

- date of issue of the protocol and the number according to the system adopted in the testing laboratory;

- name or name of the testing laboratory and registration number of the accredited testing laboratory (depending on the scheme of declaration);

- a list of testing equipment;

- conditions of the test;

- name of the product;

- name and actual values of the tested parameters and characteristics of the products;

- registration numbers and titles of the regulatory documents on the applied testing methods.

4.4. The manufacturer shall take all necessary measures to provide stable production and compliance of the manufactured products with the requirements of the present Technical Regulations (scheme 1c); the manufacturer also takes all the necessary measures to ensure stable operation of the management system (scheme 2c).

4.5. The actions of the certification body are the following:

- identification of the light industry products according to item 2 of the present Article;

- sampling and testing of the samples of the products for evaluation of their compliance with the essential requirements of the present Technical Regulations;

- analysis of the current state of the production (scheme 1c);

- issue of the certificate of conformity according to the unified form approved by the Commission of the Customs Union.

4.6. Duration of the certificate of conformity is specified upon certification:

- according to scheme 1C, 2C - no longer than 5 years;

- according to scheme 3C - no longer than 3 years.

4.7. The manufacturer (or the person authorized by the manufacturer) and the seller (supplier or distributor) should perform the following actions:

- labeling of the products by the unified confirmation mark on the market of the Member States of the Customs Union;

- after the completion of all procedures on the affirmation of compliance, the list of the documents for the light industry products includes the following documents:

testing report (reports);

the results on the production state (scheme 1c);

certificate of conformity.

4.8. Certification body performs the inspection control over the certified light industry products by testing the samples in the accredited testing laboratory and (or) by the analysis of the production state.

The accredited testing laboratory shall perform tests and prepares the test report with the results of the tests on the product samples for the inspection control.

Frequency of the inspection control - 1 time per year.

5. The file of documents on the light industry products should be kept on the territory of the Member State of the Customs Union:

for standard batch of products, by the manufacturer (or the person authorized by the manufacturer) for not less than 5 years from the date of the ban (withdrawal) of the production of the light industry products;

for batch of products, by the seller (supplier or distributor), manufacturer (the person authorized by the manufacturer) for not less than 5 years from the date of last sales of the last sold item from the batch and should be supplied to the State Inspection Body upon request.

Article 12. Unified marking (labeling) of products on the market of the Member States of the Customs Union

1. The light industry products that meet the requirements of these Technical Regulations and have the conformity assessment should be marked by the unified marking&labeling symbols (market access certification mark or conformity mark) for the market circulation of the Member States of the Customs Union.

2. Marking with a unified conformity mark for the market circulation on the market of the Member States of the Customs Union is performed before the products are released into their market circulation.

3. Unified conformity mark of the products on the market of the Member States of the Customs Union is applied onto the products by any method that provides legible and correct image.

Light industry products are marked with the unified conformity mark for the market circulation on the market of Member States of the Customs Union when they satisfy all acting essential technical regulations of the Customs Union which act in this area and require the unified labeling&marking.

4. Unified conformity mark on the market of the Member States of the Customs Union can be applied to the packaging, inserts, labels or should be provided in the attached documents.

Article 13. Disclaimer Clause

1. When the light industry products on the market do not meet the essential requirements of the present Technical Regulations and other Technical Regulations of the Customs Union containing the requirements for these products and when the products under market circulation do not have the appropriate conformation documents (documents on compliance) and (or) do not have any confirmation marks required for market circulation of the products on the market of the Member States of the Customs Union, the authorized bodies of the Member State of the Customs Union must take all measures for the restriction and ban of such products on the common Customs territory of the Customs Union as well as for the withdrawal of the products which do not meet the essential requirements of the present Technical Regulations or other Technical Regulations of the Customs Union which establish the requirements for such products.

2. The authorized body of a Member State of the Customs Union shall notify the Commission of the Customs Union and all authorized bodies of other Member States of the Customs Union about the approved decision and the reasons as well as should provide the supporting documents explaining the necessity of the adopted measured.
